A closer look at the responsibilities of New York nursing homes

Nursing homes have certain responsibilities to nursing home residents. The long-term care facilities have obligations to provide a safe and healthy environment for elders and patients. Their obligation includes the prevention of bedsores, nursing home errors, and abuse, injuries and premature deaths. Nursing home residents should be well-taken care of and supervised by the nursing home staff.

On October 30, two nursing home residents were involved in an assault in Ocean Promenade Nursing Rehabilitation Center in Rockaways near Queens, New York. According to the report, a man allegedly broke the footrest off of his wheelchair and used it against another elderly man. The victim was killed in the dispute.

In such a case, the nursing home is not directly to blame for the victim's death. However, there may be issues associated with a nursing home that may contribute to an unsafe environment in the facility. One factor may be inadequate staffing.

If a nursing home staff or a resident is abusing another resident, the problem should be administered by the nursing supervisor. In doing so, the appropriate measures to solve the dispute can be made. The facilities should perform an investigation regarding the complaint. Nursing homes should take into account unsafe situations for the residents. In instances where the nursing home fails to take action, the facility may be held legally responsible.

Families of nursing home residents, including those in New York, trust nursing homes when it comes to the care of their beloved family members. Unfortunately, nursing home abuse or neglect does occur, endangering nursing home residents in many ways. If it does happen, there may be legal options that may help the family recover compensation for the damages caused by injury or death of the nursing home residents.
