High rate of C-sections increases birth injury risks

Cesarean section deliveries are among the most common surgeries now being performed in the United States, including New York.

In fact, the percentage of births by surgery has grown rapidly since 1970, when only one in 20 births were from C-sections, to one in five women in 1996, to the current one of every three. Some experts have termed the increasing number of C-sections as an epidemic.

Although many more women now give birth through C-sections, there has been no evidence that C-section delivery is safer than traditional vaginal birth or makes for healthier babies. Some reports claim that newborns are 2.4 times more likely to die in C-sections than vaginal births.

Usually, C-sections are done in pregnancy cases in which the baby is showing signs of distress or the mother has heart disease or another serious condition or illness that makes normal delivery dangerous. However, in many cases of C-section delivery, mothers are in good shape and can deliver their children by normal vaginal birth. Some experts believe that C-sections are used by some doctors as protection from medical malpractice lawsuits that might follow from birth injuries from normal deliveries.

Although C-sections are sometimes necessary to save the mother, the baby or both from potential harm, they may also cause complications and birth injuries to newborns, particularly if surgery was delayed or improperly done by physicians. In such a birth injury case, the victim and the family may face medical difficulties associated with the birth injuries as well as substantial ongoing and debilitating financial challenges that could lead to bankruptcy.

A legal professional may be able to help an injured party achieve compensation if negligence contributed to a child's birth injury. If that is the case, the victim and the family may be eligible to receive compensation for the damages.
