New York driver struck, killed while waiting for tow truck

An Oct. 29 accident left a 21-year-old woman dead in Suffolk County, reportedly. According to police, the woman became involved in the crash while waiting for a tow truck on Sunrise Highway in Bay Shore shortly after noon.

Authorities reported that the woman's sedan had been in disrepair on the shoulder of the highway when the event occurred. After calling a tow truck, she was purportedly waiting inside her vehicle when a Chevy Caprice struck it. Officials pronounced the woman dead at the scene of the incident. The woman was from Long Island's Deer Park, reportedly.

The 51-year-old Chevy driver was hospitalized following the crash. Authorities reported that the man suffered critical injuries, for which he received treatment at Southside Hospital. Officials there said that the 51-year-old man was in stable condition. Police did not file any criminal charges immediately after the accident but are still investigating the wreck, authorities stated.

While further investigation into this case may not yield any evidence indicating criminality was involved in the wreck, it is still possible that new evidence will come to light suggesting that the accident could have been avoided if not for the actionable behavior of an involved party. If, hypothetically, investigators were to discover signs that reckless or distracted driving contributed to the accident, then there may be grounds for the family of the decedent to pursue civil action.

If successful, a wrongful death lawsuit may provide compensation for certain pecuniary and noneconomic losses that the decedent's family suffered as a consequence of the fatal auto accident.
