Drivers' convictions overturned in General Motors recall

A man is seeking to have a conviction overturned for a 2006 accident in New York in which he served six months in jail for negligent homicide. The man is one of several who was charged in accidents that later appear to have been caused by a faulty ignition switch in General Motors vehicles. After learning about the incident, General Motors waited about a decade to issue a recall. The man has since received a settlement from the company.

General Motors set up a fund for individuals injured in the defective vehicles, and some of the people wrongly charged have filed for compensation. However, at least one man has rejected the offer from the company and filed a lawsuit. He was taken into custody in May 2014 in connection with an accident from 2011, three months after General Motors issued a recall. A private investigator learned of the recall, and the charges were dropped.

Another woman's fiance was killed in 2004, and she pleaded guilty to negligent homicide. Her plea has since been reversed. Yet another woman had her guilty plea to involuntary manslaughter vacated. Experts expect more individuals to ask for their names to be cleared, and there may be additional lawsuits.

Identifying the responsible parties is an important aspect of receiving compensation following a car accident. People may be seriously injured, and they might seek compensation through insurance. Accidents may be the fault of the automobile manufacturer or of the another motorist. The responsible driver's employer may also be liable if the driver was on the job at the time of the accident. People who feel that they have been unfairly blamed for an accident or who are having difficulty obtaining what they feel is fair compensation after an accident may wish to consult with an attorney.
