Manslaughter charges filed in case of nursing home neglect

The death of an elderly woman in a New York nursing home has resulted in manslaughter charges for a nurse's aide in a case of nursing home negligence. It is reported that the aide dropped the 86-year-old woman during a transfer into her bed from a wheelchair, causing the woman to fall to the floor. The patient suffered serious injuries, including fractures to her leg and spine, which allegedly caused her death.

The nurse's aide was attempting to transfer the woman from her wheelchair without assistance, which is in violation the guidelines regarding the transfer of patients. Standards of care require that two people perform such a transfer. After the patient fell, the aide who dropped her allegedly did not seek help immediately. Instead, officials say, she attempted to recruit another aide to lie and say that she had been present during the lift before finally getting help for the injured patient.

When you place a loved one in a care facility, you are relying on the staff of that facility to follow guidelines and standards of care to ensure the safety of its residents. Yet, many times, patients can suffer a variety of health issues or even be injured as the result of nursing home neglect or the failure to prevent falls. Patients who are not properly monitored can develop bedsores, suffer falls, or even become dehydrated and malnourished.

When a loved one is injured or dies as a result of nursing home neglect or negligence, you may want to consult with an attorney to explore your legal options. When you place a loved one in a care facility, you are placing your trust in the facility and its staff to keep your loved one safe. When they fail in this duty, they can be held accountable.
