Police investigate fatal accident involving pedestrian, truck

The New York City Police Department is continuing to investigate a fatal accident that occurred when a city garbage truck allegedly hit and killed an elderly woman in West Brighton. The woman, 91, was crossing Clove Road when the accident occurred at 7:30 a.m. July 18.

The woman died at the scene of the accident where Clove Road intersects with Delafield Avenue on Staten Island. Neighbors said the victim walked to a deli on Clove Road every morning from the home she shared with her family a short distance away.

Clove Road was closed to traffic for four hours while police investigated the accident. The refuse collection truck is owned by the New York City Department of Sanitation. Police cited the driver for failure to yield to a pedestrian. Neighbors said the intersection has a blind spot, and drivers turning left from Delafield onto Clove cannot see pedestrians. Close also curves and goes from three lanes to two near where the accident occurred. Because of these factors, neighbors speculated this is how this accident occurred, though police have made no public statement as to how the pedestrian accident took place.

The victim's surviving family members may be eligible for a wrongful death claim as a result of this accident. The fact that police cited the truck driver may increase the family's chances for compensation. Wrongful death compensation can include burial expenses and loss of income if the victim was contributing to household expenses. If the woman did not die immediately from her injuries, the claim might include pain and suffering.
