Vehicle-pedestrian accident in New York kills woman

A vehicle-pedestrian accident killed a 36-year-old mother of three from Hebron and seriously injured a 40-year-old woman on Dec. 1. The pair was taking a walk along Route 197 in Argyle when a Buick sedan heading southbound struck them from behind. According to the Washington County Sheriff's Office, the pedestrians were walking along the shoulder of the road facing oncoming traffic in the northbound lane. The sedan was heading southbound, and the 58-year-old driver from Salem swung out of the lane in an attempt to pass a vehicle when he struck the women.

The fatally-wounded victim was pronounced dead at Glens Falls Hospital, and the other woman had multiple broken bones but was said to be in stable condition the following day. The accident was reported at 7:16 p.m., and a senior investigator indicated that the driver never saw the two walking because the area is poorly lit.

The driver was not injured, and no charges have been filed; however, the investigation is ongoing. Police reported that there was not any indication that the driver was impaired or that he was speeding. An accident reconstruction report is pending, and police are trying to locate the driver of a dark-colored or maroon car that the driver involved in the incident was trying to pass.

In a case such as this where a fatality or serious injuries occur, it is probable that police will thoroughly research what specific events led to the accident to determine if any parties involved were at fault for a wrongful death. For example, if police search the driver's cellphone records and discover that he had sent a text right before the incident happened, they may charge him with negligence.
