New York man indicted for negligent homicide

Recently, the police arrested a New York City man for his role in a motor vehicle accident that occurred several months ago. The accident claimed the life of one man and injured another.

The accident occurred when the defendant, who was riding a motorcycle, struck a car, causing the driver to lose control. The car then collided with another motorcyclist. As a result of the impact, both the defendant and motorcyclist were thrown off their motorcycles. Emergency responders pronounced the second motorcyclist dead at the scene. The defendant was seriously injured but later recovered. The driver of the car had only minor injuries.

After months of investigating the incident, the police obtained a grand jury indictment charging the defendant with criminal negligent homicide. The police investigation found that the accident resulted, in part, from the defendant's speeding and reckless driving.

In addition to defending against the criminal charges, the defendant may find himself liable in civil court as well. In New York the personal representative of a decedent's estate may bring a wrongful death suit if an individual died as the result of the wrongful conduct of another party.

A wrongful death suit can result in a monetary award that compensates survivors for expenses, such as medical and funeral costs. Plaintiffs may also be entitled to compensation for the income the decedent would have provided to their family had their life not been cut short.

The law surrounding wrongful death suits is complicated. Suits must be filed within a specific period and only certain individuals can sue. It is hard to know what to do after a loved one has been killed in an auto accident. An attorney might be able help a decedent's heirs figure out what they need to do and when.
