Pedestrian interstate highway accidents

New York cities are filled with pedestrians every day. People are always at risk of accidents while walking near traffic. If a pedestrian accident takes place on an interstate highway, the question of legal liability can become complex.

Pedestrian fatalities on interstate highways account for more than 10 percent of all pedestrian fatalities. People may be on or near highways when they have been involved in an automobile accident or are assisting one, because they are crossing the highway, or because they are working on a vehicle that has broken down. Sometimes accidents happen because a driver fails to see a pedestrian. Pedestrians are sometimes considered at fault for an accident involving a car, even if the pedestrian is injured.

There are times, however, when a pedestrian who is injured by a vehicle could be entitled to compensation. On an interstate highway, state or federal agencies could be held responsible if the highway was unsafe. Roadways must be maintained to be safe for all people who may use them, including pedestrians, even if they are not allowed on the road.

Pedestrians often suffer serious injuries as a result of accidents with vehicles. In many cases, they are standing on the roadside exchanging driver's license and insurance information with other motorists after being in an earlier traffic collision. Other times, they are fixing a flat tire or attending to some mechanical problem with their own car when they are hit. An attorney representing an injured pedestrian will review the results of the official police investigation as well as other evidence such as eyewitness accounts in order to determine whether to proceed with a personal injury lawsuit against the driver of the vehicle that hit the client.
