Helping New Yorkers in failure to diagnose malpractice claims

Even before they are on the operating table or at the pharmacy, Long Island and Queens residents who have been to the doctor are already putting a lot of trust in him or her. The first, and most basic, thing a doctor does for his or her patients is to tell the patient what is wrong via a formal diagnosis.

The diagnosis serves as the blueprint for how to treat a patient, since the cure or treatment obviously depends on what the problem is. As a result, waiting too long to diagnose or making a mistake in doing so can have serious consequences, since it means a patient might not get the treatment he or she needs or, worse, gets the wrong treatment.

A failure to diagnose can have serious consequences, including significantly worsened medical condition or, in the worst cases, even death. The sad thing about these sorts of cases is that they are preventable when a doctor follows the appropriate protocols for how to diagnose a patient's condition.

For example, with respect to cancer cases, a doctor's failure to order the appropriate medical tests when he or she should reasonably suspect cancer can cost a patient dearly because many treatments available to them during the early stages of cancer simply will not work later. On a related point, sometimes, a doctor does order these sorts of tests but does not understand them correctly and therefore concludes they are normal when they in fact show cancer.

In general, misdiagnosis happens when a doctor starts treating the symptoms he or she observes without fully understanding why the patient is having those symptoms. This can be a huge, costly mistake. Although doctors are human and can make such mistakes, patients should not have to pay for them with shortened lives and more medical bills. Victims of misdiagnosis are therefore invited to contact our law office for further information on how to obtain compensation.
